December 4, 2008 • Ask the Experts
This is your opportunity to ask our panel of know-it-all attorneys any legal questions you want – hopefully related to homeowner association law. Take advantage of this (rare) opportunity to get some free advice. We’ll also recap the year’s significant legal developments and provide you with our predictions for the coming year.

In the last few years, we’ve seen more and more legislation prohibiting associations from banning certain items in communities: flags, political signs, emergency vehicles, satellite dishes, and energy efficiency devices; who can keep it all straight? In this session we’ll review the list of protected items and discuss how much leeway associations really have in regulating them.
February 5 • Productive Meetings: How Can We Handle Disruptions and Actually Get Work done?
Disruptive owners, arguing directors, and conversations going off on tangents - sound familiar? We’ll focus on different strategies for making your meetings more productive, controlling the crowds, and keeping conversations on point to help make your meetings more productive and reasonable in length.
March 5 • Ins and Outs of Insurance
Are your associations adequately insured? Are there gaps in coverage? Are the coverages contained in the policies cancelled out by the exclusions? We’ll provide you with tools to assist you with interpreting the foreign language that is insurance.
April 2 • Are You Discriminating?
With discrimination complaints on the rise, you can’t afford to not be “in the know” on the latest trends and decisions of the Colorado Civil Rights Division. We will delve into specifics of situations where reasonable cause for discrimination has been found and situations where it was not. We’ll also discuss situations where associations are most exposed and vulnerable to claims and what you can do to protect your communities.
May 7 • Governing Documents: The Time to Change Is Now
Do your communities’ governing documents provide basic rights and powers to manage the community? Do the governing documents adequately protect liability to the extent allowed by Colorado law? In this session, we will discuss the basic and non-negotiable powers and protections all governing documents should contain to allow for proper management of the community.
June 4 • Are Your Rules Working For You?
All too often an association creates and attempts to enforce a rule that it later finds out is unenforceable. Whether it violates state or federal law, or is contrary to your governing documents. We’ll discuss what associations can and cannot put in their rules. We’ll also focus on the practical side of rules enforcement and how a rule that may be lawful, may still be practically unenforceable.
July 9 • Renters in the Community—Friend or Foe?
Many say renters are a mixed bag when it comes to community impact. Many complain that renters do not care for communities like owners and are therefore bad for communities. On the other hand, others believe that allowing renters raises property values. Who’s right? We’ll discuss these and other issues pertaining to renters and how best to address them.
August 6 • Dealing with Difficult Owners
How do you handle the disruptive owner at a board or annual meeting? What about the owner who continues to call, email, calls you names and demands review of various association records over and over again? What rights and duties do you have when it comes to these types of problematic owners? We’ll discuss different strategies for dealing with these, and other, problematic owners in your communities, and help you keep your cool when things get heated.
September 10 • Maintenance and Insurance Obligations—Who Does What?
With maintenance and insurance obligations oftentimes being assigned to different parties, there is understandably much confusion over such obligations. This class will focus on techniques to help determine repair and insurance obligations. We will also discuss the protocol for insurance claim submissions and how to tell if and when the association is required to submit claims on behalf of owners.
October 1 • Don’t Get Caught - Contract Musts
How do you know when a contract is safe to sign and adequately protects the association? We’ll answer this and other questions in this class, as well as, discuss the basic provisions every contract should have (regardless of whether it’s a $100 project or a $10,000 project) to protect the association.We’ll also provide you with tools for spotting the “red flags” in proposed contracts.
November 5 • Staying Out of Court and What To Do If You Can’t
In our litigious society, it seems anyone is willing to sue anyone for just about anything. Therefore, it’s important for associations and managers to protect themselves and limit their exposure to liability. This session will focus on safeguards to minimize risk of legal action and, when those safeguards are not enough, what to do when legal action is initiated.
